1. INTRODUCTION

1.1. LUNESI LTD (company type: private limited company) is a company registered under the law of England and Wales with company number 15497453 whose registered office is at 128 City Road, London, United Kingdom, EC1V 2NX ("Lunesi”, “we”, “us” and “our”). https://www.lunesi.co.uk/ (hereinafter the “Website") is the property of and is operated by Lunesi.
1.2. The purpose of these Terms & Conditions (the “Terms”) is to set out the terms that apply to you, an individual consumer (“Customer”, “your” and “you”), when using the Website and/or placing orders with us for buying the Products from Lunesi (“Order”). The “Customer”, “your” and “you” shall be understood as “consumer” under the Consumer Contracts Regulation 2013 and other United Kingdom law. Under these Terms, you may purchase on the Website from Lunesi any products (“Products”).
1.3. These Terms are only applicable to you if you are an individual consumer. If you are a business purchasing the Products please contact us for details.
1.4. These Terms are subject to modification and updates accordingly. The Terms applicable to Orders by Customers are those applicable on the date of the Order on the Website. By visiting our Website and/or making an Order, you agree to be bound by the Terms herein.
1.5. Please read these Terms carefully before purchasing Products from our Website.
1.6. These Terms regulate conditions of selling Products on the Website by Lunesi.

 


 

2. THE CUSTOMER

2.1. To be a Customer you must be a consumer, of legal age and with full legal capacity (or be authorised by your parents) to order on the Website.
2.2. When becoming a Customer, you will be asked to provide certain information in order to create an account on the Website. The personal information you give to Lunesi when opening your customer account, or upon placing any Order, must be complete, accurate and up to date. Lunesi is not responsible for undelivered Products should the data prove incorrect.

 


 

3. BASIS OF CONTRACT

3.1. The Order constitutes an offer by the Customer to purchase Products in accordance with these Terms. The Customer is responsible for ensuring that the terms of the Order are complete and accurate.
3.2. The Order shall only be deemed accepted when Lunesi issues acceptance of the Order, at which point a contract shall come into existence (the “Contract”).
3.3. Acceptance by Lunesi of the Order outlined in clause 3.2 may be provided by a request to the Customer to pay for the Products and/or by issuing an invoice. In this case, the Customer shall pay within one business day. Failure to do so means the Contract is not concluded.
3.4. Lunesi may choose not to ship Products without 100% prepayment, which does not constitute a breach of the Terms. The payment is considered complete once Lunesi receives the funds.

 


 

4. THE PRODUCTS

4.1. The Products available for purchase are those listed on the Website. Lunesi may periodically update the list of available Products by removing, modifying, or adding them.

4.2. Lunesi makes every effort to accurately present and describe the Products. However, it is possible that the Website may contain minor errors, which you acknowledge and accept. If the Products delivered are not as described, Lunesi agrees to remedy the issue by either exchanging the Product(s) or refunding you (totally or partly, as appropriate) the amount paid under these Terms.


 


 

5. PLACING AN ORDER

5.1. Any Order(s) shall be placed via the Website and in accordance with these Terms. You will need to provide us with certain information before you can complete your Order and will have the opportunity, before confirming your Order, to verify the Order details and the total price to be paid. By placing the Order on the Website, you also agree to the Privacy Policy. Once the Product(s) have been shipped based on your Order, the Order cannot be modified.

5.2. Once you have confirmed your Order and made payment via the Website, Lunesi will promptly confirm receipt by sending you an email to the address you provided.

5.3. The confirmation email will include the information provided by you, the Products purchased, and the total price including any additional costs (such as shipping fees). Shipping fees are not included in the Product price.

5.4. Lunesi reserves the right to refuse or not process an Order when:

  • the Order is made by a Customer with whom a dispute exists in connection with a previous Order, or who has failed to comply with these Terms;

  • Lunesi temporarily does not have the chosen Products in stock;

  • you place an Order from countries not served by Lunesi.

In such cases, Lunesi will inform the Customer by email that the Order has been refused or will not be processed.

 


 

6. PRICE AND PAYMENT

Important: For all Products shipped outside the UK, the Customer will be responsible for any import duties or taxes charged by customs and any carrier-related fees. Additional charges will be collected by the shipping carrier at the time of delivery.

If the Customer is a resident of the European Union and the Order value does not exceed EUR 150, Lunesi will act as a tax intermediary and include VAT in the invoice. For Orders exceeding EUR 150, the Customer is solely responsible for VAT, duties, and related charges upon delivery.

If the Customer resides outside the EU or UK, they assume full responsibility for all applicable local taxes and duties.

6.1. Product prices on the Website are shown in Pound Sterling or other supported currencies. The final total (excluding shipping) is displayed in your basket prior to payment. Shipping is always paid by the Customer.

6.2. Lunesi reserves the right to modify its prices for Products and shipping on the Website at any time.

6.3. The Customer must complete payment on the Website to finalize the Order. Lunesi reserves the right to cancel any unpaid Order not paid within two business days.

6.4. You may pay using a credit card, PayPal, or any other method accepted on the Website. For card payments, Lunesi uses a secure payment system provided by TIDE. By using this method, you authorize Lunesi to debit your account for the full Order amount.

6.5. For payment through portals, follow the online instructions. After payment, click PROCEED TO PAYMENT to confirm. A full Order review page will appear.

6.6. All Order payments must be made in full without set-off, counterclaim, deduction or withholding (except as required by law).

7. DELIVERY

7.1. Lunesi will deliver the Products to the address you provide when placing your Order, which must be your place of residence or work. Lunesi reserves the right not to deliver to hotels or PO boxes. All delivery dates are approximate, and time is not of the essence.

7.2. For deliveries outside the United Kingdom, you agree that delays may occur due to customs or unpaid fees. You are solely responsible for making any required customs payments promptly.

7.3. To help ensure timely delivery, you must provide accurate and complete address information (e.g. building number, access codes, intercom info). Inaccurate details may cause delays or failed deliveries. You are responsible for costs related to such issues.

7.4. Predicted delivery times are indicative of the average time to process an Order and to deliver Products. Lunesi will not be held responsible for delayed delivery due to external causes. When you place the Order you will see estimate delivery time of the Products from time of receive a payment by Lunesi. Lunesi does not ship Products to you without receiving 100% prepayment.

7.5. In the event the Products are damaged on delivery (e.g. already opened and/or missing Products), the Customer must notify the transport service and Lunesi (by filling in contact form) of the issues and their rejection of the Products within one (1) day following the delivery provide proof as specified in clause 8.4. of these Terms.

7.6. If delivered to you Product(s) is/are damaged and (or) with bad quality and you do not notify us that you reject the items as well you not return the indicated above Products within the time frame, you will not be eligible for a refund or exchange of the Products herein.

PLEASE NOTE "damages" does not include damage to outer packaging (delivery box or tube box) caused by the postal service.


8. RETURNS & REFUNDS

8.1. Lunesi is committed to providing Products of the highest quality.

8.2. Returns and exchange of Products may be made by the Customer within (14) fourteen calendar days after the date you receive your Product (s) from Lunesi. You can return the Products and withdrawn from the Contract within outlined above term and without declare any reasons if:

  • the Products have not been used;

  • the Products remain in their original packaging;

  • the Products are still in their original condition.

After finishing (14) fourteen days as indicated above you cannot request Lunesi about refund or exchange the Products. Please note that you cannot request Product exchange if you return (exchange )Products without declare reason and the Products are without damages and are with good quality. In this case you have right for refund only.

Please note, if you return the Products without declaring any reasons and the delivered Product (s) are with good quality and without damages, you cover all fees for delivery of the Products to Lunesi. We will make a refund when we will receive the Products and they will comply with clause 8.2 of the Terms.

8.4. If you will receive the Products and they are with damages and (or) bad quality or you received non-ordered Product you shall contact Lunesi within one business day business day from date of Product and provide proof of outlined above issues. Proof can be provided through photo or video evidence. We will respond to your complaint within five (5) business days and notify you of our decision. If it is determined that we are at fault, we will request the return of the Products and we cover all related costs. Alternatively, if the Customer agrees, we may offer to exchange the Products for different ones, with either no refund or a refund of the price difference. In the event that the replacement Product is of higher value than the originally purchased item, the Customer may choose to pay the price difference. The exchange will only be processed upon receipt by Lunesi of the originally delivered with damages and (or) bad quality, and (or) non-ordered Product to the Customer.

8.5. For each return, please head to our Help Centre and fill in our contact form stating the reason for the return or refund. Our customer service team will then provide you with all necessary instructions including the return address as well as a return authorization number that needs to be stated on the return package. Anyway, the costs of returning the Products will be the responsibility of the Customer, if outside the United Kingdom with taking into account other rules under the 8.3. of these Terms.

8.6. The Products must still be in their original packaging and in their original condition (i.e. not used, scratched, damaged or opened) under clause 8.2. of these Terms. If Products are returned and are not in their original condition, Lunesi will not provide a refund for the Products. Should the Customer then wish for the Products to be returned back to them, the Customer will be required to pay the re-delivery costs.

8.7. We make refund or exchange of Products within (7) seven calendar days from the date when we receive Product(s) under these Section 8 of the Terms. As were indicated above we make a refund if you comply with clause 8.2., 8.4. or clause 8.6. of the Terms (exchange depends on situation). We will not make a refund and/or exchange and/or return if you will send to us another Product (s) as was declared.

8.8. We will review return or refund requests under this Section 8 of the Terms if you provide proof of Products purchased from Lunesi. Acceptable proof includes a receipt, bank statement about making a payment for Products, or other documents as required by United Kingdom law.

9. LIMITATION OF LIABILITY

WARNING TO CUSTOMERS: you are strongly advised to read this Section.

9.1. Lunesi is liable to you in accordance with the Consumer Protection Act 1987 and UK law.

10. COPYRIGHT AND TRADEMARKS

10.1. All content included on the Website, including images, illustrations, designs, icons, photographs, video clips, text, reviews, and other materials (collectively, the “Content”) is the property of Lunesi or its licensors, partners or affiliates and is protected by United Kingdom and international copyright laws.

10.2. Unauthorized use of any Content or materials on the Website is strictly prohibited and may violate copyright and trademark laws. If you wish to use any Content, you need the express written permission of Lunesi. 10.3. All trademarks, service marks, and trade names (collectively the “Marks”) that appear on the Website are proprietary to Lunesi, or the other respective owners of such Marks. You may not display or reproduce the Marks in any manner without the prior written consent, and you may not remove or otherwise modify in any manner any trademark notices from any content offered or received through the Website.

11. MARKETING

11.1. By accept these Terms you give consent to Lunesi’s SMS or email marketing when making an Order or subscribing via our subscription tools, you agree to receive recurring text notifications (for the Order and abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase. You can withdraw consent by contact Lunesi.

11.2. Your right to privacy is important to us. You can see our privacy policy here  to determine how we collect and use your personal information.

12. DISCOUNTS, LOYALTY, AND RELATED MATTERS

12.1. Lunesi may occasionally offer promotions, loyalty programs, special discounts, and similar offers ("Promotions"). You acknowledge that the specific terms of each Promotion may be outlined in separate documents referencing these Terms (the "Rules"), and you agree to those terms.

12.2. If there is any inconsistency between the Rules and these Terms, the Rules governing a particular Promotion will take precedence. However, the Rules cannot override or cancel these Terms. For example, if Lunesi launches a Promotion offering a 10% discount on a third product when you purchase two, as stated in the Rules, this does not mean you forfeit your right to return and receive a refund for the Products, as provided by these Terms. In this case, the Rules serve as an appendix to these Terms and supplement them.

13. OTHER IMPORTANT TERMS

13.2. These Terms are agreed between you and Lunesi.  No other person shall have any rights under or connection with these Terms under United Kingdom law.

13.3. If any court or competent authority decides that any term of these Terms is held to be invalid, unlawful or unenforceable to any extent, such term shall, to that extent only, be severed from the remaining terms, which shall continue to be valid to the fullest extent permitted by law.

13.4. Headings are for reference purposes only and in no way define, limit, construe or describe the extent or scope of such section.

13.5. Any failure by Lunesi to enforce any provision of these Terms shall not constitute a waiver of that or any other provision and will not relieve You from the obligation to comply with such provision.

13.6. These Terms set forth the entire understanding and agreement between you and the Company with respect to the subject matter hereof.

13.7. These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

13.8. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms agreement or their subject matter or formation (including non-contractual disputes or claims).

13.9. These Terms were last updated on June 12, 2025. If we decide to update the Terms, we will notify you 30 days in advance before the new version takes effect, and no additional consent will be required from you. This means you cannot prevent us from updating the Terms. The new Terms will automatically come into effect 31 days after we provide you with notice, and the updated version will be published on that day. We will notify you of these changes via email or any other available means. If we do not receive a rejection of the Terms from you during this period, it will be assumed that you accept the new Terms. If you do not agree with the updated Terms, you must inform us. You acknowledge that rejecting the new Terms may result in the loss of access to the Website, the ability to purchase Products, or engage in other activities on the Website, etc. By continuing to use the Website or make purchases and so on after the new Terms take effect, you accept the revised version of new Terms.
